1. Vertragsschluss

– Katalog: Die Website stellt einen unverbindlichen Online-Katalog dar.
– Anfrage: Ein Vertrag kommt erst zustande, wenn Sie über den „Inquiry“-Button, per E-Mail oder Telefon anfragen und wir den Kauf sowie die Verfügbarkeit schriftlich bestätigen.
– Vorbehalt: Zwischenverkauf und Irrtümer bleiben ausdrücklich vorbehalten.

2. Zustand & Authentizität

– Vintage-Charakter: Wir vertreiben gebrauchte Objekte mit historischer Substanz. Authentische Patina, Gebrauchsspuren und die originale, zeitgenössische Bauweise sind wesentliche Bestandteile der Beschaffenheit.
– Beschreibung: Die vereinbarte Beschaffenheit ergibt sich aus der Kombination von Fotos und Text. Weitergehende Garantien (z. B. lückenlose Herkunft) bestehen nur bei expliziter schriftlicher Nennung.

3. Gewährleistung & Rückgabe

– Fristen: Mängelansprüche verjähren ein Jahr nach Erhalt der Ware.
– Abweichungen: Alterstypische Merkmale und geringfügige Abweichungen stellen keine Mängel dar.
– Erlöschen: Gewährleistungs- oder Rückgaberechte entfallen bei eigenmächtigen Veränderungen am Objekt durch den Käufer oder Dritte.

4. Preise & Zahlung

– Währung: Alle Preise verstehen sich in Euro (€). Es gilt die Differenzbesteuerung (§ 25a UStG); die MwSt. wird nicht separat ausgewiesen.
– EU-Handel: Steuerfreie innergemeinschaftliche Lieferungen sind für gewerbliche Käufer nach erfolgreicher Prüfung der USt-IdNr. möglich.
– Eigentumsvorbehalt: Die Zahlung erfolgt per Vorkasse oder bar bei Abholung. Bis zur vollständigen Bezahlung bleibt die Ware Eigentum von studioLORONO.

5. Versand & Prüfung

– Versand: Versandkosten werden individuell abgestimmt und vom Käufer getragen.
– Prüfpflicht: Der Käufer muss die Ware bei Erhalt auf Transportschäden prüfen. Sichtbare Schäden sind sofort beim Zusteller zu vermerken; verdeckte Schäden sind uns innerhalb von 24 Stunden mit Fotos zu melden.
– Rücksendung: Im Falle eines Widerrufs trägt der Käufer die unmittelbaren Kosten der Rücksendung (auch bei Speditionsware). Eine Erstattung setzt den originalen Auslieferungszustand voraus.

6. Haftungsbeschränkung

– Umfang: Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit.
– Leichte Fahrlässigkeit: Bei einfacher Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den bei Vertragsschluss vorhersehbaren, vertragstypischen Schaden. Eine weitergehende Haftung ist ausgeschlossen.

7. Urheberrecht (Copyright)

– Schutz: Sämtliche Inhalte (Bilder, Texte) sind urheberrechtlich geschützt. Jede Verwertung durch Dritte bedarf der ausdrücklichen schriftlichen Zustimmung von studioLORONO.

– Inquiry: A contract is only formed when you send an inquiry via the „Inquiry“ button, email, or telephone, and we confirm the purchase and availability in writing.
– Reservation: Prior sale and errors are expressly reserved.

2. Condition & Authenticity

– Vintage Character: We sell pre-owned objects with historical substance. Authentic patina, signs of wear, and the original, contemporary construction are essential parts of the agreed condition.
– Description: The agreed condition is determined by the combination of photos and text. Further guarantees (e.g., seamless provenance) only exist if explicitly stated in writing.

3. Warranty & Returns

– Deadlines: Warranty claims for defects expire one year after receipt of the goods.
– Deviations: Characteristic age-related features and minor deviations do not constitute defects.
– Expiration: Any warranty or return rights expire immediately if the buyer or a third party performs unauthorized interventions or modifications to the object.

4. Prices & Payment

– Currency: All prices are in Euro (€). Differential taxation applies (§ 25a UStG); VAT is not shown separately.
– EU Trade: Tax-free intra-community delivery is possible for commercial buyers after successful verification of the VAT ID.
– Retention of Title: Payment is made via advance payment or cash on collection. The goods remain the property of studioLORONO until full payment has been received.

5. Shipping & Inspection

– Shipping: Shipping costs are coordinated individually and borne by the buyer.
– Duty to Inspect: The buyer must inspect the goods for transport damage upon receipt. Visible damage must be noted immediately with the carrier; hidden damage must be reported to us within 24 hours with photos.
– Return Shipping: In the event of a revocation, the buyer bears the direct costs of returning the goods (including freight items). A refund requires the original delivery condition.

6. Limitation of Liability

– Scope: We have unlimited liability for intent and gross negligence as well as for injury to life, body, or health.
– Slight Negligence: In the case of simple negligence, we are only liable for the breach of essential contractual obligations and limited to the typical, foreseeable damage at the time the contract was concluded. Any further liability is excluded.
